Restrictive Market Practices Based on a Position of Dominance

- Abstract -

Competition authorities have an important task of preventing dominant companies from unjustifiably aggravating the market conditions of their (possible) competitors by providing discounts or by a refusal to establish or maintain business relations. While the Hungarian competition authority has launched a substantial number of procedures in this context in the last decade, only a relatively minor number have successfully identified any abuse. This is because its decisions tended to focus not on the interests of competitors but essentially on the longer-term interests of consumers and on a desire to maintain a willingness to invest.
